Article 2 — Purpose and Scope
These Terms and Conditions define the rights and obligations of the Seller and the Buyer in connection with the sale of original paintings and, where applicable, other artistic creations offered on the website celinekobierzynski.com.
They apply to sales made to private individuals and, where applicable, business customers.
By placing an order, the Buyer acknowledges having read these Terms and Conditions, without prejudice to any mandatory rights granted to consumers by law.
Article 3 — Presentation of Artwork
The artworks offered for sale are presented through photographs accompanied by a description specifying, in particular, the title, dimensions, medium and price.
The Seller endeavours to represent each artwork as accurately as possible. However, colours may appear differently depending on the screen and its settings.
Unless otherwise stated in the artwork's description, the sale includes only the painting described. The inclusion of a frame, hanging system or accessories is specified in the artwork's description.
Each original painting is a unique work of art. Variations inherent in the handmade process and the use of painting materials do not, in themselves, constitute a lack of conformity.
Article 4 — Prices
All prices are stated in euros.
The applicable price is the price displayed at the time the order is placed. Delivery costs and any other mandatory charges are indicated before the order is finally confirmed.
VAT rates: 6% applies to all original artworks and limited-edition prints; 21% applies to unlimited-edition prints.
The Seller reserves the right to change prices for future sales. Any price changes will not apply retroactively to orders that have already been concluded.
Article 5 — Orders
The Buyer selects the desired artwork and provides the information required to place the order.
Before confirming the purchase, the Buyer may check the artwork's characteristics, the total price, any applicable charges and the delivery information.
The order is considered concluded when the Buyer receives an order confirmation by email and payment has been validated, or when a quotation for a custom order has been accepted in writing.
The Seller sends the Buyer a confirmation on a durable medium, particularly by email.
For custom orders, the agreed specifications, price, payment terms and estimated completion time are confirmed in writing before work begins.
Article 6 — Payment
Payment may be made using the following methods:
Klarna, Apple Pay, PayPal, Bancontact and major debit and credit cards (Visa, Mastercard, Amex, etc.).
The following payment terms apply:
Full payment is required at the time of ordering for all orders placed on celinekobierzynski.com.
For custom orders, the Seller may request a 40% deposit, with the terms confirmed in writing.
Any consequences of cancellation and the treatment of amounts already paid are determined in accordance with the agreed terms and applicable legislation.
Article 7 — Delivery and Collection
The following delivery options are available:
-
Delivery areas: Belgium, the European Union and the rest of the world, subject to postal service availability.
-
Delivery methods: Studio collection, delivery via Bpost or another delivery service, depending on the size and weight of the artwork and the destination country.
-
Delivery costs: Between €10 and €650, depending on the size and weight of the artwork and the destination country.
-
Estimated delivery time: 7 business days. Orders are processed within 3 business days; the actual delivery time depends on the delivery service.
For commissioned artworks, the estimated completion time depends on the work required, the drying time of the paint and the preparation of the artwork for transport.
If a significant delay occurs, the Seller will inform the Buyer and comply with the legal rules governing delivery times.
The artwork is carefully packaged to minimise the risk of damage during transport.
If any damage is noticed upon receipt, the Buyer is encouraged to contact the Seller promptly and provide photographs of both the packaging and the artwork. This helps facilitate the handling of the claim without limiting the Buyer's legal rights.
The risk of loss or damage is transferred in accordance with applicable legislation. For consumers, the risk generally remains with the Seller until the Buyer takes physical possession of the goods, except in legally recognised circumstances, particularly where the consumer independently chooses a carrier that was not offered by the Seller.
Article 8 — Right of Withdrawal and Returns
For distance purchases made by consumers, the statutory right of withdrawal generally applies for a period of 14 calendar days from receipt of the artwork, subject to the exceptions provided for by law.
Where this right applies, the Buyer may withdraw from the purchase without having to provide a reason.
To exercise this right, the Buyer must inform the Seller of their decision through a clear statement, for example by email or letter, before the statutory deadline expires.
The Seller will refund the amounts due in accordance with the law, including the initial standard delivery costs where these must be refunded. The refund will be made within the statutory time limits and may, under the conditions laid down by law, be postponed until the goods have been recovered or proof of dispatch has been received.
Return shipping costs are borne by the Buyer and will be agreed upon with the Seller.
The goods must be returned in accordance with the applicable legal requirements. The Buyer may be held responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, under the conditions provided for by law.
Exception for Custom-Made Artwork
The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised, where the conditions for the statutory exception are met.
This exception may apply, in particular, to a painting created specifically using the customer's photographs, requested dimensions or personal instructions.
It does not automatically apply to original paintings that have already been created and are offered for sale.
For further information about the applicable rules, please consult the Belgian Federal Public Service Economy's official guidance on the right of withdrawal.
Article 9 — Legal Guarantees
Artwork sold to consumers is covered by the applicable statutory guarantees, including the legal guarantee of conformity where provided for by law.
For new goods sold by a professional to a consumer, the legal guarantee of conformity generally applies for two years from delivery of the goods.
This guarantee does not cover defects that the consumer was aware of at the time of purchase, or damage resulting from improper use or storage, within the limits provided for by law.
Any claim relating to a defect or lack of conformity may be sent to oxalif1@gmail.com.
These Terms and Conditions do not limit any mandatory rights granted to consumers.
Article 10 — Custom Orders
Custom orders are subject to a prior agreement between the Seller and the Buyer.
This agreement specifies, in particular:
-
The subject and characteristics of the artwork.
-
The dimensions and support.
-
The agreed price.
-
The payment terms and deposit arrangements.
-
The estimated completion time.
-
The delivery arrangements.
Any changes requested after approval of the project may result in an adjustment to the price and completion time, subject to the agreement of both parties.
Custom orders are not eligible for the right of withdrawal where they fall within the applicable statutory exception for goods made to the consumer's specifications or clearly personalised goods.
In the event of cancellation or any difficulty concerning an order, the parties will seek a solution in accordance with their agreement and applicable legislation.
Article 11 — Intellectual Property
Purchasing an original artwork does not transfer the copyright associated with that artwork.
Unless authorised in writing by the Seller or otherwise permitted by law, the Buyer may not reproduce, distribute, sell or commercially exploit images of the artwork.
The Seller retains all intellectual property rights in their creations, within the limits provided for by applicable legislation.
Article 12 — Liability and Care of Artwork
The Seller takes the necessary care in creating, packaging and preparing artworks for shipment.
The Buyer is encouraged to follow the care instructions provided with the artwork, particularly regarding humidity, direct sunlight, temperature fluctuations and handling.
This provision does not limit statutory guarantees or the Seller's liability in circumstances provided for by law.
Article 13 — Personal Data
Personal data collected when an order is placed is used to process the order, arrange payment and delivery, comply with accounting and legal obligations and, where applicable, handle customer enquiries.
Further information regarding the purposes of processing, recipients, data retention periods and individuals' rights is provided in the Privacy Policy.
Article 14 — Complaints and Dispute Resolution
For any questions, complaints or difficulties relating to an order, the Buyer may contact the Seller at the following address:
Email: oxalif1@gmail.com
The parties will endeavour to resolve any dispute amicably.
If no agreement can be reached, the dispute will be handled by the competent courts in accordance with the applicable legal rules. Nothing in these Terms and Conditions deprives consumers of the mandatory protections afforded to them by law.
Article 15 — Applicable Law
These Terms and Conditions are governed by Belgian law, subject to applicable mandatory provisions, particularly those protecting consumers in cross-border sales.
